AGREEMENT TO OUR LEGAL TERMS

We are GoDomains, operated by Cloudme Digital Co. W.L.L (“Company,” “we,” “us,” or “our”), a company registered in Bahrain at Office 24, Building 624, Road 2808, Block 428, Seef 428. Our VAT number is 220002875100002.

We operate the websites https://godomains.bh, https://godomains.qa, and https://godomains.ae (the “Sites”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and GoDomains, concerning your access to and use of the Services. By using the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms.

If you do not agree, you must discontinue use immediately.

OUR SERVICES

The Services are intended for users aged 18 and older. Persons under the age of 18 are not permitted to use or register for the Services.

The Services are provided on an international basis but may not be lawful in all jurisdictions. You are responsible for compliance with all local laws.

The Services are not designed to comply with industry-specific regulations (e.g., HIPAA, GLBA, FISMA). You may not use the Services in a way that subjects us to such regulatory frameworks.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the Services, including code, databases, software, design, trademarks, and content (“Content” and “Marks”), are owned or licensed by us.

You are granted a limited, revocable, non-transferable licence to access and use the Services for personal or internal business purposes. Any other use requires our prior written consent.

USER REPRESENTATIONS & REGISTRATION

By using the Services, you represent and warrant that all information provided is accurate, and that you will comply with these Legal Terms and all applicable laws.

You may be required to register an account. You must keep your password secure and are responsible for all use of your account.

PRODUCTS, PURCHASES & PAYMENTS

Refunds Policy: All sales are final. No refunds will be issued.

PROHIBITED ACTIVITIES

You may not misuse the Services, including but not limited to:

  • attempting to breach security measures,

  • transmitting malware or harmful code,

  • impersonating others,

  • collecting data without permission,

  • using Services for unlawful or harmful purposes.

USER CONTRIBUTIONS & SUBMISSIONS

By submitting content, feedback, or ideas, you grant us full rights to use them without restriction or compensation. You remain responsible for any content you provide and confirm you have the necessary rights to share it.

THIRD-PARTY SERVICES

The Services may integrate with third-party providers (e.g., registries, hosting platforms, payment gateways). We are not responsible for third-party content, services, or actions.

PRIVACY POLICY

Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to data collection and processing in Bahrain.

SERVICE AVAILABILITY & MANAGEMENT

We reserve the right to suspend, limit, or discontinue Services at any time without liability. We may block users or IP addresses if deemed necessary for security or compliance.

TERM AND TERMINATION

We may suspend or terminate your account at any time for breach of these Terms or applicable law, without liability.

MODIFICATIONS & INTERRUPTIONS

We may modify or discontinue Services without notice. While we strive for uptime, we do not guarantee uninterrupted availability.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of Bahrain. Disputes shall be resolved by arbitration under the International Commercial Arbitration Court (ICAC) of the European Arbitration Chamber. Seat of arbitration: Manama, Bahrain. Language: Arabic.

DISCLAIMER

The Services are provided “as is” and “as available.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant uninterrupted or error-free operation and disclaim liability for third-party content, security incidents, or domain registry actions.

LIMITATIONS OF LIABILITY

To the fullest extent permitted by applicable law:

  1. No Indirect Liability – GoDomains (Cloudme Digital Co. W.L.L.), its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, revenue, goodwill, or data, even if advised of such possibility.

  2. Service Availability Disclaimer – The Services are provided “as is” without any guarantee of uninterrupted or error-free availability. We shall have no liability for downtime, interruptions, data loss, or delays.

  3. Maximum Liability – In no event shall our total liability, whether arising in contract, tort (including negligence), or otherwise, exceed the lesser of (a) BD 15, or (b) the total fees actually paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

  4. Exclusions – We disclaim liability for:

    • domain disputes, cancellations, suspensions, or registry actions;

    • actions of ICANN, registries, or regulators;

    • data loss, security incidents, or third-party failures not caused by our gross negligence;

    • failures of payment processors, hosting providers, or integrated third-party services.

  5. Acknowledgement – You acknowledge the inherent risks of Internet-based services. Your sole remedy for dissatisfaction with the Services is to discontinue use.

  6. Non-Excludable Rights – Nothing herein excludes liability for fraud, willful misconduct, or liability that cannot be excluded under Bahraini law.

INDEMNIFICATION

You agree to indemnify and hold harmless GoDomains and its affiliates against any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

USER DATA

We may retain and process your data as described in our Privacy Policy. You are solely responsible for backing up your data. We disclaim liability for loss or corruption of user data.

ELECTRONIC COMMUNICATIONS & SIGNATURES

By using the Services, you consent to electronic communications and agree that electronic signatures and records have the same force as written ones.

MISCELLANEOUS

These Terms constitute the entire agreement between you and GoDomains. We may assign rights without notice. If any provision is held unenforceable, the remainder remains in effect.
